Terms of Service
These Terms of Service ("Terms") govern your use of webifystudioagency.com and any website design, development, or maintenance services provided by Webify Studio ("we," "us," or "our"). By purchasing a package or using our services, you agree to these Terms.
1. Services
We design and build websites for small businesses based on the package you choose (Basic, Standard, or Premium), and offer an optional monthly Maintenance Plan. Package details are listed on our pricing page. Any work outside your package, such as extra pages or custom features, will be quoted separately before we begin.
2. Payment
- Build fees are paid upfront, in full, through Stripe before work begins.
- The Maintenance Plan is billed monthly through Stripe and renews automatically until canceled.
- Prices are in U.S. dollars. The amount shown at Stripe checkout is the amount charged.
3. Timelines
Delivery times (2, 3, or 5 days depending on your package) start once we've received payment and everything we need from you, including text, images, logos, and account access. Delays in providing materials or feedback will extend the timeline.
4. Revisions
Each package includes the number of revision rounds listed on our pricing page. A revision is a change to content or design within the original scope. New pages, new features, or a change in direction after approval count as new work and will be quoted separately.
5. Your responsibilities
You confirm that you own or have permission to use all content you provide, including text, images, logos, and trademarks, and that it doesn't violate any law or anyone else's rights. You're responsible for the accuracy of your business information on your site.
6. Ownership
Once your build fee is paid in full, you own the final website design and the content created specifically for you. Third-party themes, plugins, fonts, and stock assets remain subject to their own licenses. We may display your finished site in our portfolio unless you ask us not to in writing.
7. Third-party costs
Unless agreed otherwise in writing, domain registration, hosting, premium plugins, e-commerce platform fees, and payment processing fees are not included in our prices and are your responsibility.
8. Maintenance Plan
The Maintenance Plan includes the services listed on our pricing page, including up to 5 hours of content updates per month. Unused hours don't roll over. You can cancel anytime; cancellation takes effect at the end of your current billing period.
9. Contractors
We may work with trusted contractors to deliver parts of your project. We remain responsible for the quality of the work delivered to you.
10. Limitation of liability
We work hard to deliver reliable websites, but we can't guarantee specific business results such as search rankings, traffic, or sales. To the extent permitted by law, our total liability for any claim related to our services is limited to the amount you paid us for those services. We're not liable for indirect or consequential losses, or for issues caused by third-party services, hosting providers, or changes made by anyone other than us.
11. Termination
Either party may end a project in writing. Refunds, if any, follow our Refund Policy. We may decline or stop work on projects involving illegal, harmful, or infringing content.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
13. Changes
We may update these Terms from time to time. The version posted on this page at the time of your purchase applies to that purchase.
